Terms of Use
Limited Liability Company VERDE WAHHE (ТОВ «ВЕРДЕ ВАХЕ»), company code (EDRPOU) 43306268, 8/1 Tykhvinskyi Lane, Kyiv 03028, Ukraine (the “Company”, “we”, “us”). The Buryaki service means the buryaki.com website and the Buryaki apps for Android and iOS (the “Service”).
These terms are an agreement between you and the Company. By using the Service, creating a profile, submitting content or making a purchase, you accept these terms and the documents they refer to: the Privacy Policy, Recipe Disclaimer, Purchases and Subscriptions Terms, Game Rules, Community Guidelines, Moderation and Reports Policy, Submission Terms and Map Notice. If you don’t agree, please don’t use the Service.
1. What the Service is
Buryaki is an informational and entertainment cooking service: a map of Ukraine’s regions, home recipes, historical and cultural information, dinner planning, profiles, a community, an interactive collecting game and paid digital content. The Service does not sell food, drinks or alcohol and does not provide catering, medical, dietary or expert historical services.
2. Eligibility
Anyone can browse content. Profiles, submissions, ratings, reports and purchases are only for adults aged 18 or older with full legal capacity. You confirm that the information you provide is true.
3. Your account
- One profile per person; your nickname and photo must not mislead, infringe anyone’s rights or be offensive.
- You are responsible for keeping your password safe and for activity on your profile.
- Your profile photo is public. Only use images you have the rights to; don’t use images of children, of other people without their consent, logos or other people’s works.
- You can delete your profile at any time (see Delete your data).
4. License to use the Service
We grant you a non-exclusive, revocable, non-transferable license to use the Service for personal, non-commercial purposes. You may not: copy the Service, its recipes or database for distribution or sale; scrape data; bypass security or paywalls; resell access; use the Service to train artificial intelligence systems without our written permission; or interfere with the Service.
5. Your content
You keep the rights to your photos and texts and grant us a license under the Submission Terms. You confirm that you hold all necessary rights and consents and, to the extent the law allows, will compensate the Company for losses caused by a breach of this promise.
6. Moderation
We moderate content under our Moderation and Reports Policy. We are not obliged to publish any content and do not monitor generally, but we act on valid notices.
7. Recipes and safety
Recipes are for information only. You are responsible for judging your own health, the ingredients, their quality and freshness, hygiene and cooking temperatures. See the Recipe Disclaimer.
8. Paid content
Purchases unlock only the digital content described in them and grant no other rights. See the Purchases and Subscriptions Terms.
9. Intellectual property
The Buryaki name and logos, design, texts, collections, code and databases belong to the Company or are used under license (see Licenses). Any unauthorized use is prohibited.
10. Disclaimer of warranties
The Service is provided “as is” and “as available”. We do not guarantee uninterrupted or error-free operation, the completeness, accuracy or currency of information, that it will meet your expectations, or any cooking result.
11. Limitation of liability
To the fullest extent permitted by law, the Company and its owners, managers, employees and contractors are not liable for: indirect, incidental or consequential losses; lost profits; lost data; harm resulting from preparing or eating dishes, allergic reactions, food poisoning or kitchen injuries; the actions of other users; third-party services; or outages beyond our control. The Company’s total liability to you is limited to the amount you paid for the Service in the last 12 months, or USD 50 if you paid nothing.
Nothing in this document limits rights that cannot be excluded under the law of your country, including consumer rights and liability for death or personal injury caused intentionally or by gross negligence.
12. Force majeure
We are not responsible for failing to perform due to circumstances beyond our control, including martial law, hostilities, attacks on infrastructure, power or network outages, cyberattacks, government decisions and supplier failures.
13. Third-party services
Google Play, the App Store, Google, social networks and sources follow their own rules; we are not responsible for them.
14. Additional terms for Apple
If you got the app from the App Store: these terms are between you and the Company, not Apple; Apple is not responsible for the app or its content and has no obligation to provide maintenance or support; if the app fails to conform to any warranty, you may notify Apple for a refund of the purchase price, and Apple has no other warranty obligation; Apple is not responsible for any claims relating to the app, including product liability, legal or regulatory compliance, consumer protection or intellectual property claims; you confirm that you are not subject to US sanctions and do not live in a US-embargoed country; and Apple and its subsidiaries are third-party beneficiaries of these terms. The App Store terms also apply.
15. Termination
You can stop using the Service at any time. We may restrict or end your access if you break these terms or the law and will tell you why unless the law prevents us.
16. Governing law and disputes
These terms are governed by the law of Ukraine. Disputes are first handled by negotiation (email legal@buryaki.com; we reply within 30 days) and otherwise by the court where the Company is located unless the law sets a different venue. Consumers in the EU, UK, US and elsewhere keep the mandatory protections of their local law and any right to sue in their home courts.
17. General
If any provision is found invalid, the rest remains in force. We may assign this agreement to a successor. Not enforcing a right does not waive it. If language versions differ, the Ukrainian version prevails unless your local law requires otherwise. We give at least 7 days’ notice of material changes.
